General

Payment for the foreign currency portion of the Contract shall be made by

establishing an irrevocable Letter of Credit between any bank authorized by

Government of Nepal (GoN) and a bank in the Contractor’s country nominated by the

Contractor. All the fees and charges required for opening of Letter of Credit will be

borne by the Employer. However, the fees and charges imposed by the Beneficiary's

bank (including all charges outside Nepal) shall be borne by the Contractor.

Payments for insurance, clearing, forwarding and transportation up to site, locally

manufactured equipment and construction and installations shall be made only in

local currency, i.e. in Nepali Rupees.

Advance Payment

Ten percent (10%) of the total Contract amount (proportionate to the quoted

currencies) shall be paid as an advance payment (in quoted currencies) against

receipt of invoice and an irrevocable advance payment security for the equivalent

amount made out in favor of the Employer. The Employer's Representative shall issue

an Interim Payment Certificate for the first installment after (i) execution of the Form

of Agreement by the parties hereto (ii) provision by the Contract of the Performance

Security and (iii) provision by the Contractor of an unconditional bank guarantee in a

form and by a bank acceptable to the Employer in amounts and currencies equal to the

advance payment.

Such Interim Payment Certificate shall be for an amount of ten (10)% of the Contract

Price for both Plant and Materials Supply and Construction & Installation works in

the currency or currencies as stated in the price schedules. The advance payment

guarantee shall certify that such payment shall unconditionally be refunded upon

receipt of an advice from the Employer's Representative. Advance payment security

shall be in the sample form specified in the Contract. The advance payment security

shall be valid up to the validity of the Contract Period or any extension thereof.

Such advance payment shall be deducted at an amount of ten (10) % from each

progress payment as an advance recovery deduction till the full advance payment is

repaid.
